The Half-Ass Trademark Case

I don’t often recommend reading court documents (boring!) but this one is worth it. As Techdirt put it, “You gotta love snarky legal filings.” The whole enchilada is available here.

The North Face is suing the parody clothing company The South Butt for trademark infringement, giving rise to some erudite logo design analysis:

The “half ass” design portion of The South Butt logo is comprised of two stripes curved in a butt-like fashion upward from the left side of the “The South Butt” text, while the “half dome” design mark of the North Face is comprised of three thinner lines curved downward from the right side of the text “The North Face.”

And so forth.

Techdirt reports that South Butt set up a Facebook app to determine if people could tell the difference between a face and a butt. You know, to rebutt claims of customer confusion.

Trademark law opens so many new possibilities for fun.
